Mr. Lundy: My attorney, Tana Couple, wants me to send you certain documents which are attached. As respects the Marsh & McLennan retirement plan, which is a very small pension ($330 a month) from a former employer years ago, Tana has advised I need the plan documents. I have requested them twice and I do not have them. They will not fax or email these to me and upon the second Phone request, they say they have mailed them. Upon my death, Brownie is the beneficiary and according to the person I spoke to, I cannot change this plan. I can forward the documents. Please verify if you are in agreement. I cannot send the plan documents for the PBGA which is my husband's Pension for having worked at Eastern Airlines a short time because i am not entitled to them since I do not have a power of attorney. Eastern Airlines went bankrupt years ago as you probably know. I only had the information I have attached because I accidently found it when I was cleaning out files. This is a Straight Life Annuity with no survival benefits according to what I read but the application is confusing. Bottom line, Ms. Copple asked me to send. Most important, Brownie is a retired military officer and under his retirement I am entitled to half of his pension. Payment will go to me direct from the Defense Finance & Defense Service of the US Military once they receive a copy of the divorce decree with the appropriate wording. Additionally under the Survival Benefit Plan, I am named as the beneficiary. Part of Brownie's pay was used to formalize this benefit in an annuity. Brownie has now said he will not interfere with my getting half of the military pension and the SBP though he was not in agreement originally. He can change the benefit so he will have to keep me as the beneficiary. We have been married sixty years. Brownie is applying for Veteran Disability Benefits (I had been urging him to do this for many years.) He has chosen the last couple of months or so to apply for these benefits. I have been told if he was already receiving the benefits I would be entitled to a SBP as well but I think he already has to be collecting at the time of the divorce. Is that correct? I have a concern that when one collects Veteran's Disability Benefits, their retirement pay pension may be reduced. If that occurs would I be effected with a reduction as well? You come highly recommended by Ms. Copple. I would appreciate your input and advise. Best regards, Vera Inman
