Greetings Matthew, I was refereed to you by my lawyer, John Napolitano. I am in need of a QDRO now that I am divorced. Attached: My ex-wife filled out a Fidelity draft QDRO, while I don’t trust it, it has all the required information you will need. I work for NetApp Inc. they also had a document, which I included calls QDRO instructions. Per your VM I included the Final Judgment and the Fully executed MSA. Lastly, here are some important facts: We are spitting the 401K - 50% / 50% We also have a 401K loan balance that I have continued to pay down, 100%. On the date she filed for divorce, the 401K loan balance was $38,801.03, today it is below $19,000. I’m not sure how the loan is treated however it is listed in the MSA as a joint martial debt. Please see attached statement from Nov of 2020. The 401 balance on Nov 6th was $344,777.78 (John is telling me this is the amount we should use for the 50% calculation). So she would get $172,388.89, minus the amount of the 401k loan correct? 401K loan snapshot on Nov 6th: 33 Nov-06-2020 $450.98 $97.89 $353.09 $38,801.03 Today the 401 is worth: $378,232.23 as of 11/25/2022 Kindest regards, Raymond W.
